Governance and Reporting obligations for P&F’s
On the 1st July, 2017 there were significant changes made to regulatory requirements for Incorporated Associations.
Australian Charities and Not-for-profits Commission ACNC Manage ReportingAnnual Information Statements
Charities registered with the ACNC must submit an Annual Information Statement every reporting period (unless they have an exception). You can check if your charity is registered by searching for it on the ACNC Register.
P&F’s now submit the following to ACNC:
-Changes in committee members should be made to ‘responsible persons’ online via charity portal.
-Changes to registered office location or opening hours. Notify ACNC of changes to Address for service
-Accounts, audits and financial returns. ACNC via your Annual Information Statement.
The ACNC has no audit requirement under $250K revenue however it is strongly recommended that it is best practice for P&F’s to complete an annual audit.
Access Canberra -Licensing & Permits

Access Canberra Incorporated associations
Access Canberra is responsible for the incorporation of associations in the ACT and maintaining the associations public record under the Associations Incorporation Act 1991 (the Act) and the Associations Incorporation Regulation 1991 (the Regulation).
There are three items that need to be reported to Access Canberra these are: (our thanks to ACT P&C Reporting requirements for sharing this summary with APFACTS)
New or amended governing documents (constitutions, rules or trust deed)
submit the constitution to Access Canberra Change of rules or objects of an association
Change to Public officer
submit the change of public officer form to Access Canberra Change of public officer particulars
Charitable collections
Exempt from needing a licence in the ACT to undertake charitable collections
Persons conducting charitable collections must be authorised by an ACNC charity (or not for profit).

Meeting Governance Standards (ACNC)
Working with vulnerable people (WWVP) registration WWVP Access
The Working with Vulnerable People (Background Checking) Act 2011 (the WWVP Act) commenced on 8 November 2012. It aims to reduce the risk of harm or neglect to vulnerable people in the ACT.
The WWVP Act requires those who work or volunteer with vulnerable people to have a background check and be registered.
ACT Reportable Conduct Scheme www.ombudsman.act.gov.au/reportable-conduct-scheme
The ACT has introduced a reportable conduct scheme to oversee how organisations prevent and respond to allegations of child abuse and misconduct. The scheme will commence on 1 July 2017.
